Couple charged with murder in emaciated boy's death

Jon Phillips and Sarah Berry were charged today with murder and child abuse resulting in the death of 7-year-old Chandler Grafner. On Sunday, authorities found an emaciated Chandler at the couple's south Denver apartment. Paramedics tried to resuscitate him when he went into cardiac arrest, but the boy died at Swedish Medical Center.

The charges allege that Phillips, 26, and his common-law wife, Berry, 21, who were supposed to be caring for Chandler, "engaged in a pattern of conduct that resulted in the malnourishment and mistreatment of the child," according to a statement from the office of Denver District Attorney Mitch Morrissey.

Morrissey alleged that their conduct was intentional and deliberate and caused Grafner's death.

Phillips, who had legal custody of the boy, and Berry each were charged with first-degree murder causing the death of a child under 12, first-degree murder after deliberation, and child abuse resulting in death.

They remain in custody in the Denver County Jail, where they are being held without bond. They are scheduled to appear in Denver County Court on Monday to be formally advised of the charges.

The pair were arrested about 10:30 p.m. Sunday
